Federal Appeals Court Rules California’s Ban on Gay Marriage Is Unconstitutional

A federal appeals court panel ruled Tuesday that a voter-approved ban on gay marriage in California violated the Constitution, all but ensuring that the case will proceed to the United States Supreme Court.

The party in San Francisco begins in 10 minutes!!

When Theodore Olsen, former Solicitor General during the Bush administration, signed on to lead the legal team for our side in this matter I was pretty certain that Prop 8 would be overturned. Olsen hit every one of Justice Scalia's hot buttons in his brief and answered them one by one.

In some respects I really hope that this case goes to the Supremes. It would be a great debate in the 30 minutes which each side gets to argue their case. Before that, though, this case will probably go to the full 9th Circuit. This was only a 3-man panel.
