I suspect the DOMA appeal is more likely to produce a breakthrough. We can hope that most of the justices, conservative as well as liberal, are asking Justice Kagan's question, "What harm will same sex marriage do?" The appellants were wise to point out that in 12 prior decisions of the court it has proclaimed marriage to be a fundamental right. If in Loving v. Virginia it could hold that a law forbidding interracial marriage is void, it can void a law against same sex marriage.Jnoreply@blogger.com
